1. Acceptance of Terms
By creating an account or using ArtPass you agree to these terms. If you do not agree do not use the platform.
2. What ArtPass Is
ArtPass is a licensed human-made art asset marketplace connecting artists with buyers including promoters, marketers, conventions, and businesses. ArtPass does not create or own the art sold on the platform.
3. Artist Responsibilities
- All submitted art must be original human-made work created by the submitting artist.
- AI-generated art is strictly prohibited and results in immediate account suspension.
- Artists must provide creation proof with every submission.
- Artists retain ownership of their work but grant ArtPass a license to display and facilitate sales.
- Artists are responsible for the accuracy of their pack descriptions and file contents.
4. Buyer Responsibilities
- Purchased packs may be used for commercial purposes as described in the license type.
- Buyers may not resell, redistribute, or sublicense pack files to third parties.
- Buyers may not claim authorship of purchased art.
- The 7.5% buyer service fee is non-refundable once a pack is downloaded.
5. Licensing
General license packs may be purchased by multiple buyers. Exclusive license packs are retired from sale after a single purchase. Open license packs are available to ArtPass members as part of their monthly allowance. All licenses are for commercial use as defined in these terms.
6. Fees and Payments
ArtPass retains 12.5% of each artist sale as a platform commission. Buyers pay a 7.5% service fee on top of the listed pack price. Listing fees of $0.35 per pack apply after an artist's first year on the platform. All payments are processed through Stripe.
7. Zero Tolerance Policy
Submission of AI-generated art, stolen art, or copied work results in immediate account suspension. ArtPass reserves the right to remove any content that violates these standards without notice.
8. Limitation of Liability
ArtPass is not responsible for disputes between buyers and artists, errors in pack contents, or misuse of licensed assets. ArtPass makes no warranties about the fitness of any pack for a specific purpose.
